Morir tras las rejas: el caso de Maximiliano

El lunes 26 de septiembre falleció un joven de 34 años apresado en la Unidad de Contención del Aprehendido (UCA – EP 9), tras no recibir asistencia médica.

 

Maximiliano tenía tres balazos en su pierna y el viernes 24 de septiembre, luego de un allanamiento en su domicilio, es ingresado a la UCA por orden de la Fiscalía 3 Turno 7.

Maxi había recibido atención en el Hospital Elpidio Torres y estaba con curaciones y medicamentos para evitar infecciones que le causaran la muerte. Cuando lo ingresan, el Servicio Penitenciario (SPC) se encargó de que Maximiliano no reciba ningún tipo de asistencia médica, incluso niega el ingreso de los medicamentos que su familia había acercado al establecimiento.

El domingo por la tarde Maxi empeora y como es común en las penitenciarias, sus compañeros de celda comienzan a llamar la atención del SPC para que se encarguen de asistirlo. Generalmente lxs internos recurren a estos métodos de “llamar la atención” en conjunto porque el Servicio Penitenciario parece que esta demasiado ocupado como para no dejar morir a las personas que tiene a su cargo. Recordemos también el caso de Cintya hace un año atrás, que al estar cursando un embarazo con un estado de salud muy delicado el SPC hizo oídos sordos a los reiterados pedidos de asistencia urgente de sus compañeras y la interna finalmente debió parir a su bebe muerto.

El mismo lunes por la mañana Jessica, la pareja de Maxi, recibe un llamado de los compañeros de pabellón que le contaron que Maxi estaba muy mal y que el SPC no lo llevaba a enfermería. Paradojicamente el EP9 esta al frente del Hospital Provincial Misericordia.. muchas excusas no había.

Luego Jessica recibe un llamado de un abogado que le comunicó la muerte de Maxi. Nadie le llamo del EP9 explicándole lo sucedido..

A continuación la familia de Maxi se hace presente en la penitenciaria para entender qué había pasado, por qué le habían negado el acceso a la salud, por qué Maxi estaba muerto, y por qué nadie salía de allí para dar explicaciones.

A la par los compañeros de pabellón de Maxi, entre tanta bronca e impotencia, comenzaron a manifestarse. Ellos sabía que cualquier podría haber sido Maxi.

El miedo que genera que la gente haga escuchar su bronca organizada, el miedo que genera la rebeldía de lxs de abajo para los opresores, el miedo que genera la digna rabia para los de arriba, hizo que la respuesta del Servicio Penitenciario sea la represión. Al grito de la digna rabia el SPC y el Grupo de Choque cordobés respondió con balas de goma, golpes y tortura. Varios internos quedaron heridos con balas de goma y fueron trasladados a otras cárceles como castigo y también para evitar la visibilidad de la tortura ante sus familiares. Varios otros permanecieron, según familiares, un aproximado de 5 horas atados en “barquito”, es decir boca abajo con los pies y manos atados en la espalda.

Los gritos que se escuchaban desde la calle eran desesperantes para cualquier transeúnte, y mas para lxs seres queridxs del pabellón amarillo que estaban en la puerta del EP9, custodiados por la guardia de Infantería, y a la espera de información, con la inquietud de saber si sus familiares estaban vivos, torturados o muertos.

Luego de que el SPC y el Grupo de Choque dejara de reprimir con balas de goma y decretará que “la situación estaba CONTENIDA”, se apersona un administrativo del EP9 ante lxs familiares, a eso de las 19hs del lunes para pasar la lista de los trasladados, y para decir que efectivamente Maximiliano había muerto por un “paro cardiorespiratorio”.

El cuerpo se lo entregarían al día siguiente a la familia y la autopsia arrojó “paro cardio respiratorio con posible infección”. Maximiliano pudo sobrevivir 3 días en el sistema carcelario, en las condiciones en las que estaba y en las condiciones en las que lo obligaron a morir. Maximiliano seguramente estaría vivo si no lo hubieran privado de su libertad, o simplemente si la privación de la libertad no fuera igual a tortura y asesinato.

A raíz de este escenario, y en diálogo con algunes familiares y allegades, nos surgen varias preguntas y reflexiones: ¿Por qué en vez de apresar a Maxi en el lugar mas insalubre del sistema carcelario cordobés, en donde la atención médica es casi nula y el hacinamiento es hasta casi el triple de la capacidad; la Fiscalía no ordenó su internación en un hospital con custodio como se debe hacer con las personas que tienen un estado de salud delicado? ¿Por qué, estando preso en el EP9, el SPC no dejó ingresar la medicación que Maxi necesitaba para no morir, y junto a la Fiscalía 3 turno 7 le negaron el derecho básico del acceso a la salud? ¿Por qué lo dejaron Morir?

¿Por qué no hubo una comunicación oficial con la familia de Maxi sobre su fallecimiento, negandoles el derecho a la información y a un duelo digno?

¿Por qué la palabra “contención” para la justicia, luego de un asesinato, implica represión y tortura? ¿Por qué ingresar a una cárcel cordobesa puede ser una condena a muerte cuando esa pena no existe en las leyes del país?
